STRATEGI PENYELESAIAN KONFLIK DALAM PEREBUTAN ASET DAERAH PASCA-PEMEKARAN DAERAH (STUDI KASUS KABUPATEN TASIKMALAYA DENGAN KOTA TASIKMALAYA PERIODE 2001-2017)
Abstract
This research happens because of so many problems in the regional
autonomy, one of the problem that really crucial in the expansion area is regional
boundary issue. Moreover, other real fact that cannot be deny is conflict / dispute
between the original region and the expansion region. One of regional autonomy
that experienced the dispute are city of Tasikamalaya with district of Tasikmalaya.
City of Tasikmalaya is officially split up with district of Tasikmalaya on October
17th 2001. Problems happen when the district of Tasikmalaya cannot give the assets
to the new regional autonomy which is city of Tasikmalaya, after finally the
problems were solved on 2013 by the help of the governor of West Java, regent of
Tasikmalaya district, and major of Tasikmalaya city do the discussion and resolve
the problems. This is one of the struggle in solving the problems that happened at
that time.
Research method that used in this research is qualitative research method
with the triangulation collecting of data. This research was conducted in the legal
body of the regional secretariat inside city and district of Tasikmalaya, assets body
BPKAD city and district of Tasikmalaya.
The result of this result shown us that both actors is facilitated by the higher
regional autonomy (province level) in solving the problem by the negotiation
process. Then the deal within city of Tasikmalaya, district of Tasikmalaya, and also
West Java province about the assets settlement owned by district of Tasikmalaya
that located in city of Tasikmalaya number: 130/240tdaksm; number: 073/Ksd.13-
Pe/x/2013; and number: 028/MoU.38-aset/2013. But then, the problem still
happening because of city of Tasikmalaya government still questioning the
certificate of Dadaha stadium that being kept by district of Tasikmalaya. Because
of that, both actors still searching the way and strategy to solve the problem between
them.
The conclusion of this research is there are 2 factors that make a problem:
human and organization. For solving the problems immediately, the certificate of
Dadaha stadium should be given to the real actor. And also should be a real action
done by both actors. By then, there are no more problems will happen among the
actors.
