This study aims This study aims at describing the BPJS Kesehatan (Badan Penyelenggara Jaminan Sosial Kesehatan/Indonesian National Health Insurance System) in Indonesia and describing the perception of Muhammadiyah scholars and Nahdlatul scholars on the law of BPJS Kesehatan. The type of the study was qualitative with primary data obtained from the perception of Muhammadiyah scholars and Nahdlatul scholars existing in DIY. The analysis used in this study was field research by Miles and Huberman model, comprising analysis from data gathering on-going process until finished within specific period of time. Result shows that in perceiving the law of BPJS Kesehatan insurance that has been executed by the government, Muhammadiyah scholars of DIY do not ban the program. Nevertheless, Muhammadiyah scholars believe that the program still contains gharar contents, such as the unclear and unsecure period of insurance. Meanwhile, Nahdlatul Scholars perceive that the BPJS Kesehatan insurance program is generally allowed to be conducted although there is a fact that the penalty system has not been fully eliminated. The mechanism of BPJS insurance is quite complicated that it makes it impossible to dismiss the first law. Therefore, if something good has already taken place, it will not be interfered just because of unresolved mechanism issues. In order to support the successfulness of BPJS Kesehatan program, it is recommended for BPJS Kesehatan to do more effective socialization as well as to perform re-structuring either from its mechanism or its basic system applied. Thus, the program will not contradict with the Islamic Syariah.
