This paper will discuss about Indonesia’s efforts in resolving the dispute of clove cigarette with the United States. The dynamic shows that, on September 2009 the US enacted the “Family Smoking Prevention and Tobacco Control Act”, the point of that act is prohibit the circulation of flavored cigarettes (clove, strawberry, grape, chocolate, vanilla, coffee) exclude menthol cigarettes. Indonesia as a country which producing the clove cigarettes must be falling on to the detriment due to the regulation which enacted by the US is too discriminatory and not based on the scientific evidence. This research using a method of library research such collecting the data and information from books, scientific journals and official publications at offline and online media. Using an analytical framework based on the concept of the international regime, the author concludes that, besides using bilateral diplomacy and negotiation steps, the dispute settlement path through the DSB WTO becomes a wise step for Indonesia in resolving the clove cigarette dispute with US.
