Fuel oil is a staple of people whose use is always increasing. The availability of fuel in the community is very important, considering that if there is scarcity anf price increase will affect the price of other basic need. Fuel oil management is controlled and regulated direct by the state as mandate of the 1945 Constitution. The problem in writing this thesis is how the legal position of Pertamini retail oil traders in the sale of fuel oil transaction. Method undertaken in the writing of the thesis is normative research, is research that examines by way of collecting literature materials in this case relating to the law of the sale of fuel transaction and protection of consumer law. The result of this study can be concluded that the sale of fuel iil incluiding downstream oil business activities and can only be done by a business entity licensed to sell fuel oil to consumers in accordance with legislation, while Pertamini is not included into business entities that have permission to sell fuel oil and declared illegal. As well as in the sale of this oil fuel Pertamini supervision related to cinsummer protection does not exist, so for the disadvantaged consumers can make a report to the Police to curb Pertamini.
