| dc.description | This study is aimed at investigating the level of people’s understanding on the mortgaging practice, the implementation of rice field mortgaging (gadai sawah), factors that support the people to mortgage their rice field and to investigate the perspective of Islamic law on the implementation of rice field mortgaging in the Village of Gombong.
This study is a qualitative research with the technique of purposive random sampling. The data in this study is collected with the methods of observation, documentation, and direct interview to the people of Gombong who have ever mortgaget/are mortgaging their rice field, whose positions are both rahin (debtor) and murtahin (creditor). The interview with the rahin is conducted with 9 respondents while with the murtahin is conducted with 3 respondents. The approach used in this study is normative approach which examines the data gained from the result of the study then analyzed based on the norms of Islamic law.
The result of the study shows that the majority of the people of Gombong which are 67% from 12 respondents have less understanding on mortgage. This is caused by the law educational background of the people of Gombong and the sources of religious knowledge that they get rarely explains about mortgaging. The practice of mortgaging done by the people of Gombong is not based on anything, either the Laws of Islamic law, but based on the habits that have been valid since a long time ago. The dominant factors that support rahin to mortgage their rice fieldsis the educational free with 45% from 9 respondents. Meanwhile, the transaction of rice field mortgaging in the village of Gombong are still not in accordance with the conditions of Islamic law, one of which is the elements of injustice and exploitation in the case of complete control by murtahin on the price of mortgage (of rice feld). | en_US |
| dc.description.abstract | Penelitian ini bertujuan untuk mengetahui tingkat pemahaman masyarakat terhadap praktik gadai, implementasi gadai sawah dan faktor yang mendorong masyarakat dalam melakukan gadai sawah serta untuk mengetahui pandangan hukum Islam terhadap implementasi gadai sawah di Desa Gombong.
Jenis penelitian ini adalah penelitian kualitatif dengan penentuan sampel secara purposive random sampling. Data dalam penelitian ini dikumpulkan dengan metode observasi, dokumentasi dan wawancara secara langsung terhadap responden yakni masyarakat Gombong yang pernah dan/atau sedang melakukan gadai sawah baik yang berkedudukan sebagai rahin maupun murtahin. Di mana wawancara kepada rahin dilakukan terhadap 9 orang responden sedangkan kepada murtahin dilakukan terhadap 3 orang rasponden. Adapun pendekatan yang digunakan dalam penelitian ini adalah pendekatan normatif yaitu mengakaji data yang diperoleh dari hasil penelitian kemudian dianalisis berdasarkan norma-norma hukum Islam.
Hasil dari penelitian ini menunjukan bahwa mayoritas masyarakat Gombong yakni 67% dari 12 responden memiliki pemahaman yang kurang baik terhadap gadai. Hal ini terjadi karena rendahnya latar belakang pendidikan masyarakat Gombong dan sumber pengetahuan agama yang mereka peroleh jarang sekali menjelaskan tentang gadai. Praktik gadai yang dilakukan oleh masyarakat Gombong mengacu pada kebiasaan (‘urf) yang telah berlaku sejak dulu, namun kebiasaan tersebut merupakan kebiasaan yang buruk (‘urf batil). Adapun faktor dominan yang mendorong rahin dalam melakukan gadai sawah adalah untuk biaya pendidikan yakni sebanyak 45% dari 9 responden. Sedangkan transaksi gadai sawah yang terjadi di Desa Gombong masih terdapat hal-hal yang belum sesuai dengan ketentuan hukum Islam, salah satunya adalah adanya unsur kezaliman dan eksploitasi dalam hal penguasaan secara penuh yang dilakukan oleh murtahin terhadap harta gadai (sawah). | en_US |
