| dc.description | Penelitian yang berjudul Perlindungan Hukum Terhadap Pemegang Hak Cipta Terkait Menyanyikan Kembali (Cover Song) Musik Atau Lagu Yang Diunggah Di YouTube ini bertujuan untuk mengetahui dan mengkaji tentang bentuk perlindungan hukum terhadap pemegang hak cipta terkait menyanyikan kembali (Cover Song) musik atau lagu yang diunggah di YouTube, dalam hal ini dengan maraknya pembuatan Cover Song tanpa izin yaitu dengan maksud mengkomersilkannya terutama melalui situs YouTube sehingga banyak pencipta maupun pemilik hak terkait merasa dirugikan baik secara moril maupun ekonomi. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian normatif. Sedangkan sifat analisis yang digunakan adalah deskriptif kualitatif. Teknik pengumpulan data dilakukan dengan cara studi kepustakaan yaitu melalui pendekatan perundang-undangan yang bersangkut paut dengan isu hukum yang diteliti. maka dari rumusan masalah ini dalam penelitian yaitu: 1. Bagaimana perlindungan hukum terhadap pemegang Hak Cipta lagu terkait menyanyikan kembali (Cover Song) lagu yang diunggah di YouTube tanpa izin menurut Undang-undang Negara Republik Indonesia Nomor 28 Tahun 2014 tentang Hak Cipta. 2. Bagaimana mekanisme dan kendala pembayaran royalti terkait menyanyikan kembali (Cover Song) lagu yang diunggah di YouTube. Sehingga untuk menganalisis permasalahan tersebut yaitu menggunakan teori perlindungan hukum. Perlindungan hukum terhadap hak cipta di Indonesia sesuai dengan amanat Undang-undang No.28 tahun 2014. Yaitu dengan konsep perlindungan hukum terhadap pemegang hak cipta terkait menyanyikan kembali (Cover Song) musik atau lagu yang diunggah di YouTube. | en_US |
| dc.description.abstract | The research entitled Legal Protection Against Copyright Holder Associated songs to sing back (Cover Songs) Music Or Songs Uploaded On YouTube aims to know and examine the form of legal protection against copyright holders relating to the cover song of music or songs uploaded on YouTube, in this case with the ramp of making a cover song without permission ie with the intent commercialize it especially through YouTube site so that many creators and owners of related rights feel harmed both morally and economically. The research method used in this research is normative research method. While the nature of the analysis used is descriptive qualitative. Technique of collecting data is done by way of literature study that is through approach of legislation related to legal issue under study, then from the formulation of this problem in research are: 1. How the legal protection against the holder of Copyright songs related songs to sing back (Cover Song) songs uploaded on YouTube without permission according to the Law of the Republic of Indonesia No. 28 of 2014 on Copyright. 2. How are the mechanisms and constraints related to royalty payments to re-sing (Cover Song) songs uploaded on YouTube. So to analyze the problem is using legal protection theory. Legal protection of copyrights in Indonesia in accordance with the mandate of Law No.28 of 2014.
