TINJAUAN FIQIH SYAFI’I TERHADAP SISTEM BAGI HASIL PENGGARAPAN PERKEBUNAN KOPI DI DESA SUMBER ALAM KABUPATEN LAMPUNG BARAT
Abstract
Sumber Alam Village, West Lampung Regency, is a village whose majority of the people work as plantation farmers, especially coffee planters. However, not all coffee planters in Sumber Alam Village work on their own coffee plantations. This is due to limited ownership of coffee plantation area or farmers who have coffee plantation land are not able to work on their own plantation area. As consequence, both of them cooperate with cultivation of coffee plantation with profit-sharing system. The contract used in the system for profit-sharing system is mudharabah contract with profit sharing according to the common agreement which refers to the local custom with the 1/2 ratio for the coffee plantation owners and 1/2 for the farmers. In general, mudharabah profit-sharing system agreement is done orally and is not specified by the deadline for the termination of the agreement.
In preparing this undergraduate thesis, the author used qualitative research method with the type of field research by collecting data in the field through the process of observation, interview and documentation. This study is descriptive analysis that explains the problems and point of view of Shafi’i fiqh then analyzed the problem with the normative approach that is adjustment with the provisions of the Syafi’i school of thought that is based on the Qur’an, Hadith and Ijma of the scholars.
After conducting the research and analyzing profit-sharing system based on field data, it is concluded that the profit-sharing system of coffee plantation cultivation in Sumber Alam Village, West Lampung Regency, if seen in terms of the cultivation agreement of coffee plantation land, is in accordance with Shafi’i fiqh. While from mudharabah contract if it is viewed from the implementation of profit-sharing system and in terms of the end of the agreement in Sumber Alam Village, it does not conflict with Shafi’i fiqh.
