| dc.description | Disertasi ini bertujuan untuk menjelaskan tentang pelembagaan politik negara modern al-Mawardi dan relevansinya dengan negara modern.
Studi ini merupakan penelitian kualitatif untuk menemukan hasil penelitian yang dicapai tentang pelembagaan politik negara modern al-Mawardi relevan dengan negara modern. Sebagai penelitian kepustakaan (Library Research) studi ini bersifat deskriptif analisis dengan menggunakan pendekatan normatif sosio-historis.
Hasil dari penelitian ini adalah; Pertama, Dalam pengelolaan negara al-Mawardi lebih mengutamakan pendekatan institusional (pelembagaan), yaitu dengan memaksimalkan fungsi pelembagaan struktur negara. Pembagian pelembagaan negara al-Mawardi yang sistematis ini harus di pahami bahwa khilafah merupakan institusi tertinggi dalam negara. Namun khilafah tidak serta merta bisa bertindak otoriter, karena kedaulatan tetap di tangan rakyat dan tetap diawasi oleh nilai-nilai agama. Kedua, Pelembagaan politik negara modern al-Mawardi mempunyai relevansi dengan negara yang menganut sistem monarkhi konstitusional yaitu negara Malaysia. Sebagai negara kerajaan yang diatur secara konstitusional. Adanya relevansi konsep pelembagaan kementrian al-Mawardi terhadap sistem pelembagaan kementrian negara Malaysia. Dalam hal ini negara Malaysia menetapkan status quo bagi pemimpin dengan konstitusi Malaysia mengharuskan pemimpin Malaysia berbangsa Melayu Muslim. Negara Malaysia juga menggunakan sistem pemerintahan parlementer yaitu perdana menteri yang menjalankan pemerintahan untuk mengurusi rakyat. Sebagaimana sistem ini juga digunakan oleh negara Republik Islam Pakistan. Dalam hal ini, pemikiran al-Mawardi bahwa seorang Wazir Tafwidh ( وزير
تفويض ) yaitu pembantu kepala negara dalam menjalankan pemerintahan juga diberikan status quo dan perlu penegasan bagi pengisian jabatan kepala negara serta jabatan-jabatan pembantunya (wakilnya) yang penting. Dalam kasus Pakistan pemimpin harus muslim. Dan seorang Wazir Tafwidh atau perdana menteri harus mampu untuk mewakili kepala negara dalam mengelola urusan-urusan negara. Ketiga, Konsep pelembagaan negara al-Mawardi sangat relevan dengan perkembangan pelembagaan negara modern dalam wilayah tata negara yang meliputi sistem pemerintahan dan administrasi negara.
meskipun al-Mawardi dalam beberapa pandangan kurang untuk di pahami tanpa didasari oleh analisis-analisis secara spesifik dan terkadang menyikapi persoalan politik secara tekstual, namun hasil pemikirannya kontekstual, aplikatif, persuasif, dialogis, rasional, dan demokratis. Al-Mawardi mampu melahirkan gagasan-gagasan politik kenegaraan yang dialektis transformatif dalam batas-batas tertentu yang relevan untuk dijadikan alternatif dalam kehidupan bernegara yang lebih demokratis dan kekuasaan yang bermartabat. | en_US |
| dc.description.abstract | This dissertation examines al-Mawardi's Islamic political view relating to his concept on institutionalization of modern state politics and its relevance to the modern state.
This research is considered as the qualitative research on the library research in which the descriptive analysis with the socio-historical normative approach is used in order to find out the political institutionalization of the modern state based on al-Mawardi and its relevance to the modern countries.
The results of this study are; First, the state management according to al-Mawardi prioritizes an institutional approach (institutionalization) by maximizing the function of institutional state structures. In this systematic division of the state, khilafah must be fully understood as the highest institution of the country. However, the khilafah system cannot governs authoritatively, because sovereignty is in the hands of the people and wholly monitored by religious values. Second, the political institutionalization of the modern state on al-Mawardi’s view has relevance to the state which adheres to a constitutional monarchy system such as Malaysia as the country that is regulated by their constitution. There are evidences on the relevance of the concept of institutionalizing of al-Mawardi on the institution of Malaysia ministry's system. In this case, Malaysia state establishes the status quo for leaders where Malaysia constitution obligate their leaders originally from Malaysian Muslim people. On the other hand, this country also uses parliamentary system for their government where the prime minister runs the government.
It is widely known that this system is also used by the Islamic Republic of Pakistan. Al-Mawardi's thought on a Wazir Tafwidh (وزير تفويض ) or the head assistant of the state who have double jobs to govern the government on one side and to give confirmation for the pivotal representatives in the government on the other. In the case, the leader must be Muslim and has ability to represent the head of state in managing state affairs. Third, the Al-Mawardi's concept of the institutionalization of the state is completely relevant to the development of institution in the modern state consisting of system of government and state administration.
Although some of al-Mawardi’s views are not well understood due to the lack of specific analyzes and textual addressing on political issues, his thoughts on it are contextual, applicable, persuasive, dialogical, rational, and democratic. Al-Mawardi is able to purposes the dialectical transformative of political ideas under certain circumstances and circumscribtion that are relevant to be used as alternatives for the sake of establishing a more democratic state life and the dignity of the government. | en_US |
