PELEMBAGAAN POLITIK NEGARA MODERN AL-MAWARDI
Abstract
This dissertation examines al-Mawardi's Islamic political view relating to his concept on institutionalization of modern state politics and its relevance to the modern state.
This research is considered as the qualitative research on the library research in which the descriptive analysis with the socio-historical normative approach is used in order to find out the political institutionalization of the modern state based on al-Mawardi and its relevance to the modern countries.
The results of this study are; First, the state management according to al-Mawardi prioritizes an institutional approach (institutionalization) by maximizing the function of institutional state structures. In this systematic division of the state, khilafah must be fully understood as the highest institution of the country. However, the khilafah system cannot governs authoritatively, because sovereignty is in the hands of the people and wholly monitored by religious values. Second, the political institutionalization of the modern state on al-Mawardi’s view has relevance to the state which adheres to a constitutional monarchy system such as Malaysia as the country that is regulated by their constitution. There are evidences on the relevance of the concept of institutionalizing of al-Mawardi on the institution of Malaysia ministry's system. In this case, Malaysia state establishes the status quo for leaders where Malaysia constitution obligate their leaders originally from Malaysian Muslim people. On the other hand, this country also uses parliamentary system for their government where the prime minister runs the government.
It is widely known that this system is also used by the Islamic Republic of Pakistan. Al-Mawardi's thought on a Wazir Tafwidh (وزير تفويض ) or the head assistant of the state who have double jobs to govern the government on one side and to give confirmation for the pivotal representatives in the government on the other. In the case, the leader must be Muslim and has ability to represent the head of state in managing state affairs. Third, the Al-Mawardi's concept of the institutionalization of the state is completely relevant to the development of institution in the modern state consisting of system of government and state administration.
Although some of al-Mawardi’s views are not well understood due to the lack of specific analyzes and textual addressing on political issues, his thoughts on it are contextual, applicable, persuasive, dialogical, rational, and democratic. Al-Mawardi is able to purposes the dialectical transformative of political ideas under certain circumstances and circumscribtion that are relevant to be used as alternatives for the sake of establishing a more democratic state life and the dignity of the government.
