| dc.description | Penelitian ini berangkat dari dua faktor yaitu kasus Viktor Laiskodat yang melakukan ujaran kebencian pada saat menghadiri acara deklarasi Calon Bupati Kupang Nusa Tenggara Timur tahun 2017 silam, dan adanya Undang-Undang Nomor 1 Tahun 2018 Tentang Revisi Undang-Undang Nomor 17 Tahun 2014 Tentang Perubahan Kedua Atas Undang-Undang Nomor 17 Tahun 2014 Tentang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat Daerah yang menimbulkan polemik terhadap Pasal hak imunitas, dan meneliti sejarah perkembangan hak imunitas saat zaman Volksraad hingga revisi Undang-Undang Nomor 17 Tahun 2014. Penelitian ini bertujuan untuk memahami, mengetahui, dan mencari jawaban tentang pengaturan hak imunitas bagi anggota Dewan Perwakilan Rakyat berkembang serta membahas permsalahan yang terdapat pada Undang-Undang Nomor 1 Tahun 2018. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif yang diperluas untuk menyempurnakan data sekunder, tempat pengambilan data penelitian ini sebagian besar dilakukan di Daerah Istimewa Yogyakarta dan melakukan wawancara di DKI Jakarta. Hasil dari penelitian ini diantaranya ialah perkembangan hak imunitas dari tahun 1969 hingga tahun 2014, terdapat pembahasan mengenai permasalahan yang terjadi pada Undang-Undang Nomor 1 Tahun 2018, lalu terdapat laporan kinerja Dewan Perwakilan Rakyat pada tahun 2017 yang membahas secara garis besar baik secara legislasi, laporan kehadiran setiap fraksi, dan pemanfaatan legislasi pada masyarakat, hingga yang terakhir penelitian ini membahas mengenai batasan dan sanksi hak imunitas pada anggota Dewan Perwakilan Rakyat. Hingga sampai pada kesimpulan adanya keinginan dari Lembaga Dewan Perwakilan Rakyat untuk menjadikan lembaga yang proposional dan lebih baik lagi. Setiap anggota Dewan Perwakilan Rakyat harun menyadai dan memberlakukan peraturan dengan lebih baik lagi dan tak sewenang-wenang. | en_US |
| dc.description.abstract | This research departs from two factors, namely Viktor Laiskodat case that hate speech during the declaration event of East Nusa Tenggara Regent Kupang Regent 2017, and the existence of Law Number 1 Year 2018 About Revision of Law Number 17 Year 2014 About Second Amendment Upon Law No. 17 of 2014 concerning the People's Consultative Assembly, the Regional People's Legislative Assembly which raises a polemic against the right of immunity, and examines the history of the development of immunity rights during the Volksraad era until the revision of Law No. 17 of 2014. This research aims to understand, know, and seek answers about the regulation of immunity rights for members of the House of Representatives to develop and discuss the problems contained in Law No. 1 of 2018. The method used in this research is normative law research which is expanded to improve secondary data, where the data collecting of this research mostly done in D.I.Yogyakarta and conducted interview in DKI Jakarta. The results of this study include the development of immunity rights from 1969 to 2014, there is a discussion of the problems that occur in Law No. 1 of 2018, and there is a performance report of the House of Representatives in 2017 which discussed in general both legislation, reports of attendance of each faction, and the use of legislation to the public, to the last of these studies discussing the limits and sanctions on the right of immunity to members of the House of Representatives. Up to the conclusion of the desire of the House of Representatives to make the institution proportional and better. Every member of the People's Legislative Assembly shall have a better and more arbitrary and enforce the rules. | en_US |
