JAPANESE GOVERNMENT’S REGULATION ON ADULT INDUSTRY AFTER PINK FILM ERA
Abstract
Background: Presently in Japan, sexually explicit materials which cater to all sorts of erotic interests and fetishes are readily available. However, this availability of modern pornography is relatively new. Essentially post World War II with imposition by the American military rules, which lasted until 1951, there was prohibition of any sexually explicit material. This continued under the Japanese government until into the late 1980. In the early 1960s, several movie studios began producing "pink films (pinku eiga)". Even though pink films may be concerned with sex, but tend to focus more on the story. At the same time as the demand for adult industry services increases, business people in the adult industry (in this case the Yakuza) take the initiative to look for women who will be employed from outside Japan that mostly come from poor countries. As a result, along with the development of the adult industry, more and more women are trafficked to japan.
Goals: The goals of this undergraduate thesis are to examine the history of Japanese people’s cultures in relation to adult industry, the negative effects that adult industry has been created, the policy taken by Japanese government to regulate adult industry, and how the altering of the policy before and after the pink film era affect adult industry. The author believes that from above explanation can be seen some interesting reasons regarding adult industry and deserves to be further examined in the study of international relations.
Methodology: The ways in collecting data and sources for completing this thesis is based on library research in which the data and resources were collected from books, journals, e-books, internet sources, and others referring to Japan films and industry studies.
Result: Based on the research, the author sees that adult industry in Japan is a complex, complicated industry which has a long history. Adult industry is still able to operate until today because there are legal, economic, and cultural factors that enable this business to continue. The problems do not only come from the industry itself but also from the regulation taken by the Japanese government, which is the Article 175 of the Japanese Penal Code or often called as Obscenity law. Its obscenity law in its current state has both negative legal and social consequences. The law's ambiguity obstructs the court system in analysis and unnecessary cases, causing uncertainty especially on the side of filmmaker and artist of the adult industry.
