PENEGAKAN HUKUM PERIZINAN PERTAMBANGAN EMAS DI KABUPATEN SAROLANGUN
Abstract
Sarolangun Regency is a district that has the potential of natural resources that can not be renewed in the form of gold metal minerals. The existence of gold in Sarolangun almost spread throughout the District, such as District Limun, Bathin VIII, Mirror Nan Gedang, and Batang Asai. The existence of gold mining activities without permission and the use of mercury in its processing many negative impact, such as polluted water, arid and barren land, floods, skin diseases, cancer, landslides and others. Overcome the problem of unlicensed gold mining which mostly happened in Sarolangun regency, the need for a firm action from the government to supervise every mining activity and enforce the law in accordance with the applicable regulations. Prior to enactment Undang-undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah, the Sarolangun regency government has the authority to grant mining permits, after the issuance of the law the authority to grant mining permits is taken over by the provincial government, thus the authority to conduct supervision and law enforcement on mining licensing becomes the authority of the provincial government. The purpose of this study is : 1) to know how law enforcement efforts permit gold mining in Sarolangun regency; 2) to know the constraints faced by the government in law enforcement of gold mining permit in Sarolangun Regency. This study includes a type of empirical legal research that discusses law enforcement of gold mining licensing in Sarolangun Regency. Resource persons in this research are Badan Lingkungan Hidup Daerah Kabupaten Sarolangun, Polres Sarolangun, dan Polsek Limun. Respondents in this research are gold miners in Sarolangun Regency. Primary data sources were obtained through interviews with resource persons and respondents while secondary data were obtained through literature study. The results show that : 1) law enforcement of mineral and coal mining licensing in Sarolangun Regency conducted by Badan Lingkungan Hidup Daerah Kabupaten Sarolangun and cooperate with Kepolisian Resor Sarolangun against gold miners who do not have permission to do gold mining. 2) the factors that become obstacles of the government in enforcing gold mining licensing law in Sarolangun Regency are government authority factor, public law awareness factor, unsupportive facilities and infrastructure factors, and the lack of awareness of landowners.
